A little about public procurement in Ukraine
This article explains the features of government procurement, tendering propitious public procrement, gives practical directions to enhance efficiency in state procurement.
The legacy of the Soviet Union, Ukraine inherited a developed energy sector, chemical industry, metallurgy, mechanical engineering. Ukraine is a major transit country for Russian gas to European markets. Only in the country produces about 20bil m3 of gas and started the growth of the richest supply of gas of the Black Sea shelf. Ukraine is an exporter of electrical energy has 15 atomic power units, thermal and hydroelectric power. Ukraine builds modern aircraft. They, together with other state-owned enterprises are one of the biggest consumers of produces and services in Ukraine. State corporations announced more than 50-60 thousand procurements annually. The annual volume of public procurement is more than 15bil of Euros.
Taking into account the holding of Euro 2012 in Ukraine there is a growth market of government procurement relating to the construction of infrastructure for the European football championship (stadiums, hotels, roads, electrical substations, etc.)
In order to avoid of abuse in the market of state procurement, to creation of competitive environment and to elude corruption, the Government has introduced legislative mechanisms of regulation of state procurement process. Over the past five years, legislation and, accordingly, the rules in government procurements have changed a few times. The existing law of public procurement contains a provision on equal participation in procurement process, both domestic and foreign manufacturers, creating a competitive environment and providing efficient use of government funds.
Without looking at the specified equality of participants and the transparency of procurement procedures, the Ukrainian realities are different from other world norms and overseas suppliers rather difficult to independently enter in to the market of state procurement. Not the least significance in this is the complexity and bureaucracy of the Ukrainian system of government procurements. Often the potential supplier frightened the need for a vast variety of different inquiry and permitting documents (tax, bankruptcy, law enforcement, department of statistics and etc).
And given the historical differences in the classification, on which Ukrainian customers refer to the works they needed of the European rules, foreign companies own almost impossible to start work in national tender.
